Terms of service

1. Who you are contracting with
The service is operated by byAUTO Pty Ltd, an Australian company. These terms are governed by the law of New South Wales, and the courts of New South Wales have jurisdiction.
2. What the service is
BidNomy collects records published by the Australian Government — approaches to market, contract notices, standing offer notices, grant awards, budget program statements and audit reports — and presents them for search, analysis and tracking. It also has AI features that answer questions over those records and over documents you upload, and a Model Context Protocol server that gives your own AI client the same tools. It is an analytical tool. It is not procurement advice, legal advice, or a substitute for the official publications.
3. Accuracy and the source record
Source records are collected on a schedule and can lag their publisher, be amended after collection, or contain errors made by the publishing agency. Where a decision matters, check the official record. AusTender, GrantConnect and the publishing agency remain the authority on their own data, and their terms continue to apply to it.
4. Your organisation and your account
The customer is the organisation, not the individual. The person who creates it is its owner, accepts these terms for it, and is responsible for what its members do.
- A seat is one named person, or one invitation that has been sent and not yet accepted. How many seats a plan holds is on the pricing page.
- The owner and any administrator can invite people, change a role and remove somebody.
- Sign-in credentials and API keys belong to one person. Do not share them.
- Tell us at admin@byauto.com if you believe an account, a seat or a key has been used without authorisation.
5. Plans, fees and payment
- Plans are annual, in Australian dollars, and shown exclusive of GST. 10% GST is added at checkout and on each renewal. The prices are on the pricing page.
- Payment is by card through Stripe Checkout. Card details go to Stripe. They do not reach our servers or our forms.
- A plan renews each year at the then-current price until it is cancelled.
- If a price changes we will email the organisation at least 30 days before it applies to a renewal.
- If a renewal payment fails the plan is not switched off straight away. It stays on while Stripe retries the card, and the billing page says the card needs attention. If it is still unpaid after that, the organisation returns to early access.
6. Free trial
A new organisation can take one 14-day trial of the Growth plan. No card is needed, and the trial is offered once per organisation. When it ends the organisation is on early access again. Nothing in the workspace is deleted because a trial ended.
7. Cancelling and refunds
- You can cancel at any time in the Stripe billing portal, which the billing page opens.
- Cancelling takes effect at the end of the period you have already paid for. The plan runs until then.
- We do not refund the remainder of a paid period, except where the Australian Consumer Law requires it.
- An organisation on early access can close at any time and owes nothing.
8. Acceptable use
You agree not to:
- resell, redistribute or republish bulk extracts of the data as a competing dataset;
- scrape or automate against the interface outside the documented API;
- attempt to identify individuals from records, use an AI feature to do it, or use the service for surveillance of a person;
- point a notification channel, a webhook or an AI client at a system you are not entitled to send data to;
- circumvent the limits your plan sets on seats or exports.
9. Your content
Pursuits, tasks, notes and uploaded files belong to you. We store and process them to run the service. Everyone in your organisation can see the shared workspace, including the documents anybody in it uploads. Conversations on the AI page stay with the person who had them, and so do that person’s API keys. We do not use your uploaded documents to train models. You can ask for an export or deletion at any time.
10. AI features
AI answers are generated from the records in the service and from the documents you attach. They can be wrong. They are drafting aids. Check anything you rely on against the cited record before it goes into a bid. AI and your data sets out what is sent to the model, who runs it, and how long your words are kept.
11. Availability
The current plans carry no uptime commitment. Scheduled changes are announced in the product. If a change removes a feature a paid plan depends on, we will email the organisations on that plan.
12. Liability
Nothing in these terms excludes rights under the Australian Consumer Law. Subject to that, and to the extent permitted by law, our liability arising out of the service is limited to resupplying it, and we are not liable for lost profits, lost bids or indirect loss.
13. Ending it
You can cancel a plan or close an account at any time. We can suspend an account that breaches clause 8. On cancellation the organisation returns to early access and keeps its workspace. On closure your content is deleted on request, or within 30 days of the account being closed, except where a record must be kept by law.
14. Changes to these terms
If these terms change we will email account holders before the change takes effect. Continuing to use the service after that is acceptance of the new terms.
